Updated October 15, 2026. This is general information, not legal advice. We cut trees. We are not lawyers, and we do not handle claims.
After Hurricane Isaias, people in Destin, Miramar Beach, Fort Walton Beach and across Okaloosa and Walton counties are finding a neighbor's tree on their house, fence or car. There are two separate questions here. The first is who gets the tree off, and that one is urgent. The second is who owes whom, and that one can wait a few days.
The tree comes off first
Arguing over who is responsible while the tree sits on your roof leaves the house open to the next rain and leaves the tree's weight on whatever it is resting on. Get the tree off. Settle the cost later.

What Florida law generally looks at
Liability for a fallen tree usually comes down to negligence. As a general rule:
- A healthy tree that a hurricane knocks over is treated as an act of nature. Nobody was at fault, so the neighbor is not automatically responsible.
- If the tree was visibly dead, diseased, hollow or leaning, and the owner knew or should have known and did nothing, the argument for responsibility gets stronger.
That is why the condition of the tree matters more than the fact that it fell. If the amount is large, talk to a Florida attorney. A tree service cannot tell you who is liable.
Document the tree before it is cut up
Whatever the answer turns out to be, the evidence is on the ground right now and it disappears once the debris is gone.
- Photograph the whole tree, the break point, the base and the root ball from several angles.
- Look for what a person could have seen beforehand: a dead crown, mushrooms or fungus at the base, hollow wood, heaved soil, old cracks.
- Save older photos or messages that show the tree's condition before the storm, even a casual picture of your yard.
- Say so when you call, so the crew knows you want the trunk and base photographed before they are cut into pieces.
Your side of the line and theirs
Most fallen trees sit on both properties. The trunk is on your house, and the stump and roots are in your neighbor's yard.
Josh can cut the tree off your house and clear what is on your property. Work on the neighbor's side needs the neighbor's okay, and a text message that says yes works as a written record. Tell your neighbor what happened and send the photos.
If the tree belongs to an HOA common area, a condo association or the city right-of-way, report it to them directly. Gated communities in Okaloosa County also need the HOA to file a Right of Entry before county crews will collect debris inside the gate.
Who deals with the debris
Josh cuts the tree and moves the debris to the road. On big jobs he can bring in a sub to haul it, so ask when you call.
Public pickup differs by place:
- Destin's city crews began on October 15 and expect the first pass to take about 17 days.
- Walton County picks up on public and private roads.
- Okaloosa gated subdivisions need the HOA's Right of Entry.
- Fort Walton Beach does not normally collect yard waste from private contractors.
- In Santa Rosa County and Milton, a hired contractor has to haul everything.
The Isaias debris pickup guide has the source for each rule. For crews working near you, see our Destin storm cleanup page and the Destin and Miramar Beach pages.
The next one
If your neighbor's tree is still standing but leaning, cracked or dying, tell them in writing now, with a photo. Written notice matters if the tree comes down later, because it shows the owner knew. Our post-storm tree assessment guide lists the signs to look for.
FAQ
Is my neighbor automatically responsible when their tree falls on my house?
No. Responsibility generally depends on negligence, which means whether the owner knew or should have known the tree was a hazard. A healthy tree blown over by a hurricane is usually treated as an act of nature. A lawyer can tell you how that applies to your case.
Can I remove the tree before we settle who pays?
Yes, and you should if it is damaging or threatening the house. Photograph everything first. Then get the tree off the house and keep your photos and your quote.
Can I cut the branches that hang over my yard?
Florida generally lets you trim what overhangs your side of the property line, at your own expense. Cutting in a way that kills or destabilizes the tree can create liability, so tell your neighbor before you start and keep the cut to what is over your property.
Does Josh handle claims or disputes with my neighbor?
No. Josh cuts trees and moves the debris to the road. He quotes the tree work. The question of who owes what is between you, your neighbor and, if it comes to that, a lawyer.
